Privacy Notice
Version 1.0.0 - Last updated: [to be completed by QuarterCharts]
This notice is given under Article 12 of Ecuador's Organic Law on Personal Data Protection (Ley Organica de Proteccion de Datos Personales, "LOPDP") and its Regulation, to the extent QuarterCharts processes personal data reached by that law. It explains what QuarterCharts does with personal data across quartercharts.com and its country subdomains, including ec.quartercharts.com.
This notice is a factual disclosure, not legal advice.
Article 12 checklist
Article 12 of the LOPDP gives every data subject (titular) the right to be informed, loyally and transparently, of the seventeen items below. Each is labeled and answered in order.
1. Purposes of the processing
QuarterCharts operates a financial and business information platform that publishes company data drawn from public regulatory sources (in Ecuador, SuperCias, SEPS and other regulators) and, where a user creates an account, provides subscription access to that platform. We process personal data for two distinct purposes: (a) business information about companies, where Ecuadorian company filings name individual administrators, legal representatives, socios (partners) and accionistas (shareholders) - we publish their name, role, and (where filed) nationality and shareholding, as part of business information about the company itself, drawn from and attributed to the public regulatory filing; and (b) account and service operation, where a person creates a QuarterCharts account, we process their email address and purchase records to provide the subscription, process payment, and communicate with them about their account, and we use analytics tools, subject to the consent regime described on the site, to understand and improve how the site is used.
2. Legal basis for the processing
For business information about companies: the individuals named are administrators, legal representatives, socios or accionistas of legal persons, disclosed by them or on their behalf in filings made public by SuperCias and other Ecuadorian regulators. LOPDP Art. 2 states that data about legal persons is outside the law's scope, and separately provides a carve-out for the contact data of professionals, comerciantes, representantes, socios and accionistas of legal persons, limited to name, role, professional postal or electronic address, and professional phone number. QuarterCharts publishes only name, role, nationality and shareholding as filed, consistent with that carve-out, and relies additionally on LOPDP Art. 7(7) (processing of data in publicly accessible databases is a lawful basis without consent) and Art. 7(8) (legitimate interest). For account and service operation: the legal basis is performance of the contract with the account holder (LOPDP Art. 7(5)) for email and purchase data, and consent, where required by the site's consent banner, for analytics (LOPDP Art. 7(1) and Art. 8).
3. Types of processing
We collect, store, organize, structure, consult, use, and where applicable disclose and make available the data described above, through our website and country subdomains. For company-filed names and roles, processing is limited to publication and display as filed; we do not score, rate, or algorithmically evaluate named individuals. For account data, processing includes account creation, authentication, billing through our payment processor, customer communication, and aggregate product analytics.
4. Retention period
Company-filed names and roles are retained and refreshed against the SuperCias filing cycle; account, billing and analytics data are retained for the periods below, including any retention after account closure.
Retention periods: [to be completed by QuarterCharts]
5. Existence of a database holding your data
QuarterCharts maintains (i) a database of Ecuadorian company filings, including, where applicable, the names, roles, nationality and shareholding of administrators, legal representatives, socios and accionistas as filed with SuperCias; and (ii) a database of user accounts, comprising email addresses and purchase records. Both databases are described in this notice.
6. Where the data comes from
Company-filed names, roles, nationality and shareholding are not collected from the individuals themselves. They come from public filings made with SuperCias (Superintendencia de Companias, Valores y Seguros) and, for other datasets on the platform, SEPS (Superintendencia de Economia Popular y Solidaria) and other Ecuadorian regulators, as required by Ecuadorian law and made public under LOTAIP Art. 7. Account data (email, purchase records) is collected directly from the user when they register and subscribe.
7. Other and further uses
We do not use company-filed names and roles for any purpose other than presenting business information about the company, attributed to the source filing. We do not sell, rent or repurpose this data for marketing, profiling of individuals, credit assessment, or any use unrelated to the business-information purpose described above. If this changes, this notice will be updated before the new use begins.
8. Who is responsible for this processing
QuarterCharts is the "responsable del tratamiento" (data controller) for the processing described in this notice. Its full legal name, legal domicile, phone number and contact email are given below, as required by Art. 12 item 8.
- Legal name:
- [to be completed by QuarterCharts]
- Contact details:
- [to be completed by QuarterCharts]
9. Data Protection Officer
Where a Data Protection Officer (Delegado de Proteccion de Datos) has been designated, their name, domicile address, phone number and email are given below, as required by Art. 12 item 9.
QuarterCharts is in the process of designating a Data Protection Officer under LOPDP Art. 48(2).
10. Who we share data with
We do not sell personal data to third parties. Company-filed names and roles are displayed publicly on the site as business information about the company, attributed to the SuperCias (or other regulator) filing; that public display is itself the "communication" described in this section, made under LOPDP Art. 36(1) (data collected from publicly accessible sources). The processors and recipients that receive account or billing data, and any international transfer and its safeguards, are listed below.
Processors and recipients: [to be completed by QuarterCharts]
11. What happens if you don't provide data
Company-filed names and roles are not provided by the individual to QuarterCharts; nothing is required of them for this data to appear, since it is drawn from the public filing. For account holders, declining to provide the email address and payment information required to create an account and complete a purchase means QuarterCharts cannot open the account or process the subscription.
12. Effect of inaccurate data
For account data, inaccurate contact or payment information may prevent QuarterCharts from delivering the service, communicating about the account, or processing payment correctly. For company-filed data, QuarterCharts publishes the filing as recorded by the regulator; if the underlying filing is inaccurate, correction must generally be made at the regulator, and QuarterCharts will update its display once the underlying filing is corrected or republished. Anyone may also use the rights channel below to request rectification directly from QuarterCharts.
13. Withdrawing consent
Where processing is based on consent (for example, analytics under the site's consent banner), that consent may be withdrawn at any time through the mechanism described in the site's cookie/consent notice, without needing to state a reason. Withdrawal does not affect the lawfulness of processing carried out before withdrawal. Processing of company-filed names, roles, nationality and shareholding is not based on consent (see item 2 above) and so is not affected by withdrawal of analytics consent; a named individual's route to object to or request removal of that data is the rights channel below.
14. Your rights
You have the right to access, rectify, update, delete (eliminacion), oppose, and request limitation of the processing of your personal data, and the right not to be subject to a decision based solely on automated evaluation. Exercise any of these rights through our rights-request form, or at the additional address below, when provided. Under LOPDP Arts. 13, 14, 15 and 16, requests for access, rectification/updating, deletion and opposition are each free of charge and will be answered within fifteen (15) days.
15. Portability
You may request a copy of your personal data in a structured, commonly used format for transfer to another responsable, to the extent your data was provided by you and is processed on the basis of consent or contract. Send portability requests through our rights-request form. The LOPDP does not itself state a response deadline for portability requests (Art. 17), so QuarterCharts will handle each such request on an individual, good-faith basis and will confirm a timeline directly with the requester.
16. Complaints
You may file a complaint with QuarterCharts directly through our rights-request form, or with Ecuador's Data Protection Authority, the Superintendencia de Proteccion de Datos Personales (SPDP), through its website www.spdp.gob.ec.
17. Automated decisions
QuarterCharts does not make decisions producing legal effects on individuals, or similarly significant effects, based solely on automated processing or profiling of the personal data described in this notice.
Timing rule for data not collected directly, or from a public source (Art. 12)
Article 12 of the LOPDP adds one more duty beyond the seventeen items above. When personal data is not obtained directly from the titular, or is obtained from a source accessible to the public, the titular must be informed within the following thirty (30) days, or at the moment of first contact with the titular, whichever of the two circumstances happens first. The statute's own text:
Statute text (LOPDP Art. 12):
"Cuando los datos personales no se obtuvieren de forma directa del titular o fueren obtenidos de una fuente accesible al público, el titular deberá ser informado dentro de los siguientes treinta (30) días o al momento de la primera comunicación con el titular, cualquiera de las dos circunstancias que ocurra primero."
This website notice, published on [to be completed by QuarterCharts], is QuarterCharts' communication to the titulares of the SuperCias-sourced company data described in item 6, Where the data comes from, of the checklist above, satisfying this thirty-day / first-contact rule for that data. Every company-profile page that shows a person's name also carries its own source-and-rights statement, printed next to the name, which repeats the source, links to this notice, and states the rights-request path at the moment the data is first shown to a reader.
A request about a company (not a person) is answered by pointing to the SuperCias source rather than through this personal-data rights channel.
